US Supreme Court to Hear Case on LGBTQ ‘Storybooks’ in Maryland Schools, Uniting Muslims and Religious groups

The United States Supreme Court has agreed to hear a case involving Maryland’s Montgomery County Public Schools (MCPS), located in a wealthy suburb of Washington, D.C. The case challenges the school district’s refusal to allow religious parents to opt their children out of lessons featuring LGBTQ-themed “Pride storybooks.” These materials, introduced to children as young as three, include content about sex workers, kink, drag, gender transitions, and elementary-age same-sex relationships.

The controversy has sparked a rare alliance among Muslims, Christians, and Jews in opposition to the policy. The Council on American-Islamic Relations (CAIR) has been at the forefront of protests in what is considered “the most religiously diverse county in the United States.”

The 4th U.S. Circuit Court of Appeals previously sided with MCPS, ruling that the English Language Arts lessons did not compel students to alter their religious beliefs or conduct, referencing the landmark 1972 Supreme Court decision in Wisconsin v. Yoder.

Montgomery County’s position on parental notification and opt-outs has fluctuated. On two occasions, the district announced plans to inform parents and allow exemptions, only to reverse course, arguing that these lessons, not being part of sex education, are exempt from Maryland’s notification and opt-out laws.

“Cramming down controversial gender ideology on three-year-olds without their parents’ permission is an affront to our nation’s traditions, parental rights, and basic human decency,” said Eric Baxter, vice president and senior counsel at Becket. “The Court must make clear: parents, not the state, should be the ones deciding how and when to introduce their children to sensitive issues about gender and sexuality.”

The case, which highlights parental rights and religious freedom, will now go before the highest court in the United States. Its outcome could have profound implications for how public schools nationwide handle sensitive topics and engage with families on deeply held beliefs.
